Terms and Conditions for Domain Name Licence Purchase

These Terms and Conditions govern the purchase and use of a domain name licence through DOMAINSAFE (hereafter referred to as "the business", "we", "us", or "our"). By purchasing a domain name licence, you ("the Customer") agree to be bound by these Terms and Conditions. If you do not agree to these Terms, you must refrain from purchasing or using the domain name licence.

1. Eligibility to Purchase

1.1 You represent and warrant that you are of legal age and capacity to enter into a binding agreement in Australia.
1.2 You acknowledge that the domain name you are purchasing a licence for complies with the licensing rules and regulations set out by the Australian Domain Name Administrator (auDA) and any other relevant regulatory authorities.

2. Domain Name Registration

2.1 Upon successful purchase, DOMAINSAFE will facilitate the registration of your domain name with the appropriate registry, subject to availability.
2.2 Domain name registration is not guaranteed until confirmation from the relevant registry is received. DOMAINSAFE will not be held responsible for any failure to secure the desired domain name.
2.3 The domain name will be licensed to you for a term of one year. You will not own the domain name but will have the exclusive right to use it for the period of the licence.

3. Licence Term

3.1 The domain name licence term will begin upon confirmation of registration and will continue for a period of one year.
3.2 You are responsible for renewing the domain name licence prior to its expiration. DOMAINSAFE may, at its discretion, send renewal reminders but is not obligated to do so. Failure to renew may result in the loss of the domain name licence.

4. Fees and Payment

4.1 All fees associated with the purchase and renewal of the domain name licence must be paid in full at the time of purchase or renewal.
4.2 DOMAINSAFE reserves the right to adjust fees at any time, and the new fee will apply at the time of your next renewal.
4.3 Failure to pay the required fees may result in suspension or cancellation of your domain name licence.

5. Use of the Domain Name

5.1 The Customer agrees to use the domain name in accordance with applicable laws and regulations, including but not limited to those set by auDA.
5.2 You must not use the domain name for any unlawful, fraudulent, or otherwise objectionable purpose, including but not limited to:

  • Infringing upon the intellectual property rights of others.
  • Hosting or distributing malicious content, including viruses or malware.
  • Engaging in illegal activities such as spamming or phishing.

6. Transfer of Domain Name

6.1 You may transfer the domain name to another party in accordance with auDA policies and the relevant registry’s procedures.
6.2 DOMAINSAFE may charge a fee for processing domain transfers.
6.3 DOMAINSAFE is not responsible for any disputes that arise during the transfer process.

7. Termination and Cancellation

7.1 DOMAINSAFE may terminate or suspend your domain name licence without notice if you breach these Terms and Conditions or engage in unlawful activity.
7.2 You may cancel your domain name licence at any time; however, no refunds will be provided for any unused portion of the licence term.
7.3 Upon termination or cancellation, you will no longer have any rights to the domain name, and it may become available for registration by others.

8. Disputes

8.1 Any disputes arising out of the use or registration of the domain name shall be handled in accordance with auDA’s dispute resolution policies and any applicable Australian laws.
8.2 DOMAINSAFE is not responsible for resolving disputes between you and third parties concerning the domain name.

9. Limitation of Liability

9.1 DOMAINSAFE makes no guarantees or warranties regarding the availability, registration, or uninterrupted use of the domain name.
9.2 To the extent permitted by law, DOMAINSAFE shall not be liable for any loss or damages arising out of or in connection with the use, registration, or termination of the domain name licence, including but not limited to:

  • Direct, indirect, incidental, or consequential damages.
  • Loss of business, profits, or data.
  • Any issues caused by third-party service providers or registries.

10. Indemnification

You agree to indemnify and hold harmless DOMAINSAFE, its directors, employees, and agents from any and all claims, liabilities, damages, costs, and expenses arising from your use of the domain name, your breach of these Terms and Conditions, or any infringement of third-party rights.

11. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the State of New South Wales, Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of New South Wales.

12. Amendments

DOMAINSAFE reserves the right to modify or update these Terms and Conditions at any time. Any changes will be effective immediately upon posting on our website or notification to you. Continued use of the domain name licence constitutes acceptance of any modified Terms and Conditions.


By purchasing a domain name licence through DOMAINSAFE, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
